The EU hit Google with the record fine - which broke the previous EU record for a monopoly case, against USA chipmaker Intel of 1.06 billion euros in 2009 - in June for illegally favoring its shopping service in search results.

Google said it had no further comment.

And while the two cases are clearly different - and the Intel verdict remains a partial one at this stage (the sanction has not been overturned as yet) - it's certainly unusual for Europe's courts to rule against Commission verdicts, offering some hope to Google's lawyers they can successful argue against the regulator's rationale.

The Commission, which ordered Google to stop the practice by September 28, is now reviewing its proposal to comply with the European Union decision.

Google has appealed a record-breaking €2.4 billion (£2.1 billion; $2.9 billion) fine from European regulators.

Intel lost its first appeal, but persisted, and on Wednesday the case was referred back to the court that had rejected it with the instruction to allow Intel to challenge more of the evidence against it.

The appeal, which the court has confirmed receiving, will take some time to be heard and is likely to result in prolonged expensive hearings, but an unapologetic Commission on Monday insisted that it will "defend its decision in court".

The EU hit Google with the record fine in June for illegally favouring its shopping service in search results, giving the company 90 days to comply or face further fines.

The EU is also investigating whether Google tried to squeeze out its rivals in online search advertising and through its Android mobile operating system.
