Commenting on the ruling, Germany Foreign Minister Sigmar Gabriel said it was a positive step that fully adhered to European values and law.

The agreement provided for the relocation of up to 160,000 people across member states, but only about 25,000 have been transferred so far.

"Solidarity can not be a la carte", Avramopoulos said, referring to a recent request by Budapest to the European Union commission to finance its border fence.

"We should not give in to threats, " he said.

Slovakia said that it accepted the top court decision but it was still against the refugee scheme.

In July, the EU Commission threatened the Czech Republic, Hungary and Poland with lawsuits for not implementing the relocation measures.

We expect all European Union countries to respect and implement the ruling.

Hungary and Slovakia had asked the court to annul the scheme, claiming that "adoption of the decision was vitiated by errors of a procedural nature or arising from the choice of an inappropriate legal basis".

Budapest announced at the end of August that it will extend the state of emergency declared previous year over the migrant crisis until March 2018, while Hungarian government spokesman Zoltan Kovacs said that the "threat of terrorism in Europe has increased", thus justifying increased border controls, according to The Associated Press.

As Deutsche Welle reports, "Only 24,000. refugees from Greece and Italy have been transferred to other states".

The European Commission has already launched an "infringement procedure" against the three nations for failing to take, or not recently accepting, refugees who have arrived in Italy and Greece in the last two years.

"The existence of those various adjustment mechanisms shows that the relocation mechanism for which the contested decision provides, taken as a whole, enables account to be taken, in a proportionate manner, of the particular situation of each Member State in this regard", the ruling states. The fences have mostly stopped migrants from passing through Hungary on their way to Western Europe but Hungary has also greatly reduced the chances for asylum-seekers to submit applications in the country.
