Odinga, who lost the 1997, 2007 and 2013 elections, however has said he has no faith in the IEBC and said the institution has to be reformed before he will run, while his nemesis Kenyatta has said the electoral commission can be dealt with after the new elections.

President Kenyatta, in a televised address, said that it was "important to respect the rule of law even if you disagree with the Supreme Court ruling".

On Friday, chief justice David Maraga cancelled the results of the August poll saying the election commission had failed to hold a legitimate election and that the results were therefore "invalid, null and void".

In an editorial on Sunday, the paper admitted it had erred in dismissing complaints raised by Mr Odinga and his National Super Alliance before the vote results were announced, and accused him of fanning ethnic violence.

Kenyatta, who garnered 8.22 million votes against the opposition leader's 6.8 million votes, said his win was a result of "the will of the people".

Four out of the six presiding judges had endorsed the ruling and had ordered a fresh election to be conducted within 60 days. "This indeed is a very historic day for the people of Kenya and by extension the people of the continent of Africa".

"The commission is revising the operational and procedural requirements for the conduct of the fresh elections", Mr Chebukati said.

However, violence broke out as opposition activists cried foul in days of unrest which claimed the lives of at least 28 people. The ruling contradicts reports issued by most election observers, both local and worldwide , including the former U.S.

"The Commission calls on all parties to the patience and understanding as we work together to organize elections free, fair, credible and peaceful", she added.

"We will not share power", Odinga, speaking in Kiswahili outside a church in Nairobi, said.

French firm OT Morpho, which provided the Kenyan electoral commission with biometric recognition and result transmission technology, kits, defended their dependability.

The other uncanny thing about the election date is that it will come just three days before what used to be called Kenyatta Day (now Mashujaa Day), a public holiday which honours Kenya's independence heroes.

"This is not a repeat of a presidential election where number 1 and number 2 goes for a run-off", he said. The elections on August 8 and statistics's announcement were signed by violent protests of Odinga's opponents who caused 28 deaths in this capital and other interior cities.

When Kenyatta was declared the victor last month, he said that "in a true democracy, all Kenyans are winners". Kenyatta, the 55-year-old son of Kenya's founding father, has already served one five-year term. "To my worthy competitor Raila Odinga, I reach out to you, I reach out to your supporters".
