A Texan is suing his date for the cost of a cinema ticket after she upset him by sending a bunch of texts to a pal while watching Guardians of the Galaxy Volume 2. He claimed that about 15 minutes into the film, she just kept texting and reading messages on her phone, and that she left the date (and left him "stranded") after he asked her to stop.

Mr Vezmar said she began texting about 15 minutes after the movie began during their first date on 6 May. When he suggested she get up and finish her texting outside the theater, Cruz left and did not return.

The woman told the American-Statesman that she refused to pay because "he took me out on a date".

The woman, who asked not to be identified, said she was unaware of the claim. "This is like one of my biggest pet peeves", he told local paper Austin American-Statesman.

"This is insane", she said while talking to the Austin American Statesman. "Will you do this or do I have to pursue the money in small claims court?".

"I had my phone low and I wasn't bothering anybody‚" she is quoted as saying.

The lawsuit he filed says her texting was a "direct violation" of the cinema hall's policy and that she affected the "viewing experience" of the patrons present. He said he told her that maybe she could go outside to text. She denied that it was constant texting. "I just went out on a date". "I feel sorry that I hurt his feelings badly enough that he felt he needed to commit so much time and effort into seeking revenge".

Tim League, the cinema company's chief executive, has said he will compensate the plaintiff with a gift certificate if he drops his lawsuit. "She deserves jail time!"
