On March 29, Pakistan had revised its declaration on compulsory jurisdiction, which spells out terms under which Islamabad accepts the ICJ on matters of dispute settlement.

India also contended it was not informed of Jadhav's detention until long after his arrest.

India moved the global court under 36 (1) of the ICJ statute, because both India and Pakistan are signatories to the Optional Protocol to the Vienna Convention on Consular Relations (VCCR). A military court sentenced him to death, alleging he was involved in espionage and anti-national activities. The recommendations outlined the strategy on how Pakistan could plead the case before the Hague-based ICJ, which has stayed Jadhav's execution. A day later, Pakistan said it was reviewing the jurisdiction of the ICJ.

The United States withdrew from the ICJ's compulsory jurisdiction in 1986 after the court ruled it owed Nicaragua war reparations.

Referring to Vienna Convention on Consular Relations, India told ICJ that Pakistan had rejected 16 requests for consular access to Jadhav since March a year ago When Islamabad claimed he was arrested in Balochistan.
